Wavy Rental Agreement
A readable, operationally specific contract for delivery-based island rentals—without hiding the money, safety or dispute terms.
Wavy Rentals, LLC reports that Georgia counsel approved this current document set. The company should retain the written approval, attorney identity, review date and exact reviewed version in its compliance records. Later substantive edits should be routed through the same change-control process before use.
Parties, rental summary and controlling documents
This Rental Agreement is between Wavy Rentals, LLC, doing business as Wavy Rentals St Simons Island and Wavy Rentals (“Wavy,” “we,” “us”), and the primary renter identified in the booking record (“Renter,” “you”). Wavy’s business and legal-notice address is 315 Mallery St, St. Simons Island, GA 31522. The vehicle, unit number, rental period, delivery location, price, authorization amount and approved drivers appear in the reservation summary and are incorporated into this Agreement.
The controlling contract consists of the reservation summary, this Rental Agreement, the Cancellation & Change Policy, the Damage Authorization Policy, and the vehicle-specific safety and legal-use guide. A later written trip amendment approved by Wavy controls only the item it changes. Marketing copy does not change the signed terms.
Reservation status and conditions to delivery
A request is not confirmed merely because it was submitted or temporarily held. Confirmation remains subject to available commissioned inventory, approved delivery access, route eligibility, payment, signed documents, valid driver credentials, the damage authorization and any insurer-required verification.
Wavy may decline or cancel before delivery if a condition cannot be satisfied. If Wavy cancels for its own inventory, access or compliance reason, Wavy refunds rental payments received for the unavailable service.
Renter and approved-operator eligibility
The primary renter and every golf-cart operator must be at least 21 years old under Wavy policy, possess a current valid driver’s license appropriate for the vehicle, be listed and approved before operation, and be capable of safe operation. Wavy’s 21+ policy is stricter than the minimum age stated in some local rules.
The Renter may not permit an unapproved, unlicensed, impaired, fatigued or otherwise unsafe person to operate the vehicle. The Renter remains responsible for custody and permitted use even when an approved additional driver is operating. Incoming scooter and moped requirements do not become active until Wavy publishes model-specific rules and opens those categories for booking.
Rental period, delivery and return
The rental begins and ends at the dates, times and approved property location shown in the reservation summary. Free delivery and pickup apply only to the approved Wavy service area and do not waive property-access, parking or handoff requirements.
The Renter will provide accurate gate, parking, host and contact information; inspect the delivered vehicle; report any material discrepancy before use; and return it to the agreed location, reasonably clean, with all keys and equipment, at the required fuel or charge level. An extension is effective only after written approval and any additional price or authorization is accepted. Keeping the vehicle after the return time without approval is a material breach.
Rental charges, taxes and payment authority
The Renter will pay the itemized rental price, applicable taxes, approved additions and permitted post-rental charges. The planned schedule is 25% at confirmation and the remaining rental balance before delivery; the final secure payment request states the actual amounts and due dates.
The Renter represents that they are authorized to use the payment method provided. Wavy uses a payment processor and does not store full card numbers. A chargeback is not a substitute for giving Wavy cancellation notice or using the documented dispute process, and nothing in this clause restricts lawful cardholder rights.
Temporary damage authorization
For the live Yamaha golf cart, Wavy may request a $500 temporary card authorization shortly before delivery. It is separate from the rental price, is not automatically captured, may reduce available credit or funds, and is not a limit on responsibility for documented loss.
The Renter authorizes Wavy and its payment processor to place, update, release and—only for amounts permitted by the signed Agreement—capture against the authorization. The complete categories, exclusions, evidence process, timing and dispute method are stated in the Damage Authorization Policy. Issuer posting and release timing are outside Wavy’s direct control.
Legal territory and route restrictions
A PTV may be operated only in the approved territory and on public streets where current law and signs permit. Glynn County presently states that PTVs may use streets posted at 25 mph or less, must not use sidewalks or bike paths, must comply with traffic laws, and must meet registration, equipment, seat and restraint rules. The route map and current signs control over general trip suggestions.
No vehicle may be taken off St. Simons Island, transported by trailer, driven on a beach, dune, sidewalk, prohibited path, state highway, limited-access road, private property without permission or any location outside the written service territory. A lawful street does not make every crossing lawful. The operator must obey police direction, posted closures and current law.
Seat belts, passengers and child restraints
Occupancy may never exceed one person per manufacturer-designated seat. Every cart occupant must use the installed seat belt while moving. The Renter is responsible for supplying, correctly installing and using any child passenger restraint required by current law; Wavy does not select or install child seats.
No rider may stand, sit on a lap, ride in a cargo or step area, hang from the vehicle, enter or exit while moving, or interfere with the operator. Helmets and protective equipment required for a future two-wheel category will be specified before that category is activated.
Prohibited and unsafe use
The vehicle may not be used while the operator is under the influence of alcohol, cannabis, illegal drugs, impairing medication or any substance that reduces safe operation. It may not be raced, speed-tested, pushed, towed, used to tow, overloaded, submerged, driven through standing water, used for commercial transport, rented onward, intentionally damaged or operated recklessly.
Phone use while moving, stunt riding, curb or median hopping, intentional skidding, off-road use, tampering with governors or safety equipment, and operation after a warning light, unusual sound, tire issue or other unsafe condition are prohibited. Smoking, vaping and illegal substances are prohibited in or on the vehicle.
Care, security, fuel and condition
The Renter will use ordinary care, remove the key when unattended, engage the parking brake, secure the vehicle in lawful parking, protect keys and equipment, and follow the delivered operating guide. The cart may not be stored where it blocks a sidewalk, path, fire lane, accessible route or neighboring property.
The Renter will not repair, modify, decorate, wash with harsh chemicals, install accessories, disconnect tracking or safety equipment, or allow service by another person without Wavy’s written approval. Ordinary wear consistent with proper use is not damage.
Inspection records and photographs
Wavy may document pre-delivery, handoff, service and return condition using time-stamped photographs, video, checklists, odometer or hour readings, fuel level, equipment inventory, technician notes and customer-submitted files. The Renter may add photographs before first use and at return.
A signed handoff or beginning use without reporting a readily visible discrepancy may be considered acceptance of the recorded starting condition, but it does not eliminate a claim involving a latent defect or inaccurate record. Inspection evidence will be evaluated reasonably and together, not through an automatic charge.
Collision, injury, theft and incident duties
For an emergency, injury, collision, suspected crime or dangerous road condition, stop, secure the scene if safely possible and call 911. Do not continue using a vehicle that may be unsafe. Notify Wavy as soon as safely possible at the listed support number and use My Trips to preserve the trip record.
The Renter will provide truthful details, operator and witness information, photographs when safe, the law-enforcement report number and insurance information; will not abandon the vehicle except for immediate safety; and will reasonably cooperate with investigation and recovery. The Renter may not admit liability on Wavy’s behalf or promise a settlement.
Breakdown, recall and service interruption
Stop operation and contact Wavy for a breakdown, warning light, tire concern, control issue or suspected defect. Do not arrange repairs, towing, jump-starting or parts without approval except emergency measures reasonably necessary to prevent immediate injury.
Wavy may inspect, repair, exchange, relocate, recover or remove a vehicle when safety, law, recall, weather, property access or condition requires it. Because launch inventory is limited, replacement is not guaranteed. Refund or credit for a Wavy-caused service failure is handled under the Cancellation & Change Policy; inconvenience alone does not authorize unsafe continued use.
Responsibility for loss and damage
To the extent permitted by law, the Renter is responsible for documented loss or damage occurring during the rental when caused by the Renter, an approved or unauthorized operator, a rider, prohibited use, breach of this Agreement, negligence, intentional conduct, failure to secure the vehicle or failure to report and mitigate an incident.
Recoverable amounts may include reasonable repair or replacement, required tax, towing, recovery, storage, missing equipment, extraordinary cleaning and loss of use only when legally permitted and reasonably documented. Wavy will credit salvage, insurance, third-party recovery and amounts already collected for the same loss. The Renter is not charged for recorded pre-existing damage, ordinary wear, a manufacturer defect or mechanical failure not caused or worsened by misuse.
Transparent post-rental charge schedule
The following schedule narrows—not expands—the categories that may be charged. Any amount remains subject to evidence, applicable law, the authorization process and the limits stated here.
- Physical damage or missing equipment: Documented reasonable parts, labor, tax, transport and replacement cost, less applicable salvage or recoveries.
- Extraordinary cleaning: Documented labor and supplies, capped at $150. Ordinary vacation sand and routine turnover are not chargeable.
- Smoke, vape or prohibited-substance remediation: Documented remediation, capped at $250.
- Fuel shortage: Actual fuel plus a $25 mobile refueling service charge when the cart is not returned at the delivered fuel level.
- Late return: $25 per started hour after a 15-minute grace period, capped at the then-current 24-hour rental rate, plus documented recovery cost if the vehicle must be retrieved elsewhere.
- Key or control replacement: Actual replacement, programming and delivery cost.
- Recovery, towing or impound: Actual third-party charges plus documented Wavy recovery labor when caused by prohibited use, abandonment, impound or renter breach.
Insurance and optional protection
Wavy does not represent that the Renter’s auto, homeowner, travel, umbrella or credit-card coverage applies to a PTV or other rental. The Renter should ask their carrier or card issuer before the trip. Any optional waiver or protection product, if later offered, is not insurance and will be governed by a separate written document.
Nothing on this site currently promises a collision- or loss-damage waiver. The damage authorization is security for potential obligations; it is not insurance and does not purchase coverage.
Open-air vehicle risks and preservation of rights
The Renter understands that an open-air, low-speed vehicle presents risks including exposure to weather, limited crash protection, road debris, changing traffic, uneven surfaces, visibility limits and the acts of other road users. The Renter accepts the ordinary inherent risks of lawful use and agrees to operate conservatively.
This Agreement does not release Wavy from liability that cannot lawfully be waived and does not excuse Wavy’s gross negligence, willful misconduct, fraudulent concealment or statutory duties. Any release, allocation of risk or limitation is intended to apply only to the maximum extent Georgia law permits.
Third-party claims and indemnity
To the extent permitted by law, the Renter will defend and indemnify Wavy from a third-party claim, fine or expense to the extent caused by the Renter’s or operator’s negligence, intentional misconduct, illegal use or material breach. This obligation is reduced by the percentage of fault attributable to Wavy or another person and does not apply to Wavy’s gross negligence or willful misconduct.
Traffic, parking, impound and property-access citations caused by the rental party are the Renter’s responsibility. Wavy may provide booking and operator information when lawfully required.
Personal property and property damage
The Renter is responsible for personal belongings placed in or on the vehicle and for checking the vehicle at return. Wavy will use reasonable care with recovered property but does not guarantee recovery or storage.
The Renter must immediately report damage to a hotel, residence, landscaping, parked vehicle or other property. Responsibility is allocated under applicable law and the facts of the incident; this clause does not create liability where none otherwise exists.
Cancellation, weather, no-show and early return
The Cancellation & Change Policy is incorporated into this Agreement. Cancellation is effective when received through My Trips or direct written contact that identifies the booking. A pending request does not alter the trip until approved.
Weather alone does not automatically cancel a reservation. The operator must stop when conditions are unsafe. If Wavy prohibits use or cannot provide material service, company-cancellation and service-failure remedies apply. Voluntary early return, reduced use, operator ineligibility, property denial caused by inaccurate booking information and no-show are handled under the published policy.
Default, suspension and recovery
Wavy may suspend use or recover the vehicle without prior notice when reasonably necessary for immediate safety, suspected theft, unlawful use, material payment default, expired rental, abandonment or serious breach. The Renter will not obstruct a lawful recovery and authorizes access to the approved delivery property to the extent the Renter has authority to grant it.
Wavy will use reasonable efforts to give notice and avoid unnecessary disruption. Termination does not erase accrued payment, damage or return duties, but Wavy may not impose a penalty or enter property in a manner prohibited by law.
Electronic records, consent and communications
By selecting the electronic-consent acknowledgement and typing the full legal name, the signer agrees to conduct this transaction electronically, intends the typed name to be an electronic signature and agrees that the signed record may be stored with the booking, timestamp, signer email, terms version and activity record. A paper copy may be requested from Wavy.
Transactional messages may be sent by email, account notification or SMS to the supplied contact information where permitted. Marketing consent is separate and optional. Electronic consent may be withdrawn prospectively by contacting Wavy, but withdrawal does not invalidate a previously completed transaction or remove obligations already incurred.
Privacy, records and lawful disclosure
Wavy uses identity, booking, payment-reference, delivery, license, agreement, support, location-related and inspection data to perform the rental, protect people and property, prevent fraud, resolve disputes and comply with law. Full card numbers remain with the payment processor.
Records may be shared with processors, insurers, professional advisers, property contacts, service providers or authorities only as reasonably needed and described in the Privacy Notice. Requests for access, correction or deletion remain subject to legal, safety, fraud, insurance and transaction-retention duties.
Notices and contact information
Reservation, change, cancellation, safety, privacy and dispute notices must identify the sender, the booking or transaction when applicable, the subject and the requested action. The designated channels and effective-delivery rules appear in Wavy’s Legal Notice, which is incorporated for notice procedure but does not override a non-waivable method required by law.
Formal written notices to Wavy may be sent to Wavy Rentals, LLC, Attn: Legal Notices, 315 Mallery St, St. Simons Island, GA 31522, with an email copy to Matthew@WavySSI.com. Urgent trip or safety issues should also be reported by telephone at (478) 396-9103; emergencies go to 911 first. Wavy may send transaction notices to the renter’s supplied email, telephone number, My Trips account or booking address. Keep contact details current and retain proof of delivery.
Complaints and dispute process
First send a written booking-linked notice describing the disputed event, amount and requested resolution. Wavy will acknowledge it, preserve available records and provide a substantive response after reasonable review. Damage-authorization disputes follow the shorter evidence timeline stated in that policy.
Georgia law governs without eliminating non-waivable protections of another jurisdiction. Subject to applicable jurisdiction and venue rules, court proceedings may be brought in Glynn County, Georgia. This Agreement does not require private arbitration, waive a lawful small-claims option, shorten a statutory limitation period or prohibit a report to a regulator, insurer, card issuer or law-enforcement agency.
General contract terms
This Agreement and incorporated documents are the entire agreement for the rental. A waiver must be written and applies only to the stated event. The Renter may not assign or subrent the reservation; Wavy may assign payment or insurance claims where lawful but remains responsible for promised rental services.
If a provision is unenforceable, it will be narrowed or severed to the minimum extent necessary and the remainder continues. Headings aid reading but do not limit meaning. “Including” means including without limitation. Obligations concerning payment, loss, records, disputes and accrued rights survive return.
Signature acknowledgements
Before signing, the Renter must be able to open the Rental Agreement, Cancellation & Change Policy, Damage Authorization Policy, Safety Center, Privacy Notice and reservation summary. The signer confirms they had an opportunity to read, ask questions, save a copy and decline the transaction.
The signer specifically acknowledges the 21+ operator policy, approved-driver rule, route and restraint restrictions, cancellation windows, $500 golf-cart authorization, responsibility for documented permitted loss, incident duties, electronic-signature consent and the statement that the authorization is not insurance or a liability cap.
